General terms and conditions HNK Coaching
Article 1 – Company Identity

These general terms and conditions apply to all agreements, programs, services, and
collaborations between HNK Coaching and the client.
Article 2 – Scope of Application
These terms and conditions apply to:
• Personal training in the Coach's private gym
• Online coaching
• Nutritional guidance
• Training schedules and personalized programs
• Use of the coaching app
• Basic and Premium programs of 1, 3, 6, or 12 months
By registering or making a payment, the client agrees to these terms and conditions.
Article 3 – Nature of the services
HNK Coaching's services are aimed at providing guidance in training, exercise, nutrition,
and lifestyle.
The Coach commits to a best-efforts obligation, not a results obligation. This means
that the Coach will perform professionally and to the best of his or her ability but cannot
guarantee specific results. Results depend on, among other things:
• Client's commitment and discipline
• Lifestyle outside of sessions
• Diet
• Sleep and recovery
• Medical and genetic factors
Article 4 – Client Health and Responsibility
The client declares:
• To be medically fit to participate in physical training
• To report any injuries, conditions, or medical limitations in advance
• To immediately communicate any changes in health
Participation in training is at the client's own risk.
If there is any doubt about medical suitability, the Coach may request a doctor's
certificate.
Article 5 – Weekly Check-in, Follow-up, and Shared Responsibility
Within each program, HNK Coaching provides structured guidance and follow-up via
the coaching app.
The weekly check-in is an integral part of the program and is an essential component of
the support. The client agrees to:
• Complete the weekly check-in via the app on time and in full.
• Provide honest and accurate information about training, nutrition, recovery, and
general well-being.
• Report any difficulties, complaints, or injuries immediately.
• Actively participate in follow-up.
If the client fails to complete the weekly check-in or share relevant information, HNK
Coaching cannot guarantee optimal guidance or adjustment.
Failure to complete check-ins or follow-up by the client:
• Does not affect the payment obligation.
• Does not entitle the client to a refund.
• Is considered limited cooperation within the program.
Coaching at HNK Coaching is based on a collaborative approach with shared
responsibility. The quality of the results depends in part on the client's active
commitment and communication.
The Coach remains available for questions or problems outside of regular check-in
times, within reasonable response times.
Article 6 – Location and Use of Private Gym
Training sessions take place in the Coach's private gym, located in their home. This is
located at Koetsweg 203, 3010 Kessel-Lo.
The client:
• Respects the house rules
• Uses the materials carefully
• Is responsible for intentional or negligent damage
HNK Coaching is not liable for loss, theft, or damage to personal belongings.
Article 7 – Programs and Payment
HNK Coaching offers programs of 1, 3, 6, or 12 months.
Payment is made monthly in advance of the month in question.
A program implies a commitment for the chosen duration, but clients can stop early
provided:
• Written notice
• 30-day notice period
• No refund of the month already paid
If a client stops early, any remaining sessions will be forfeited after the end of the
current month.
Prices include VAT.
Article 8 – Pausing due to illness or injury
In the event of injury or medical conditions, the program can be temporarily paused.
Conditions:
• Written notification
• Medical certificate required in case of a prolonged interruption
• The program will be extended by the duration of the break
No refund will be provided for temporary interruptions.
Article 9 – Cancellation Policy
The Coach operates with a clear but reasonable cancellation policy.
• Cancellation less than 24 hours in advance: the session will be charged
• Timely cancellation: the session will be rescheduled
• Force majeure will be assessed on a case-by-case basis
The Coach reserves the right to reschedule sessions in case of illness or force majeure.
Article 10 – Online Coaching
With online coaching, the client is responsible for:
• Correct execution of exercises
• Safety during training
• A suitable training environment
HNK Coaching is not liable for injuries that occur outside of physical training in the
private gym.
Article 11 – Intellectual Property
All training programs, nutrition plans, documents, videos, app content, and other
materials remain the property of HNK Coaching. After the coaching session, the
coaching application may no longer be used unless explicitly permitted by the Coach.
It is prohibited to:
• Share it with third parties
• Copy it
• Use it commercially
Without the Coach's written permission.
Article 12 – Liability
HNK Coaching has professional liability insurance.
The Coach's liability is, in any case, limited to the amount covered by the insurance.
HNK Coaching is not liable for:
• Indirect damage
• Consequential damage
• Injuries due to incorrect execution of instructions
• Withholding of medical information by the client
Article 13 – Privacy and Data Processing
HNK Coaching processes personal data in accordance with GDPR legislation.
Health data is used exclusively for coaching purposes and is treated confidentially. The
client has the right to:
• Access
• Correction
• Deletion
• Restriction of processing

Article 14 – Force Majeure
Force majeure means any unforeseen circumstance beyond the control of the Coach,
including but not limited to:
• Illness
• Government measures
• Pandemics
• Fire or damage to the training location
In such cases, the program may be suspended or modified.
Article 15 – Disputes and applicable law
This agreement is exclusively governed by Belgian law.
In the event of a dispute, the courts of the district where HNK Coaching is established
have jurisdiction.
